Hip Replacement Recall 2011
Do I have my math wrong? This site is called Hip Replacement Recall 2010, and here’s a post about Hip Replacement Recall 2011.
What gives? Here’s the scoop:
Hip Replacement Recall 2011
To the best of my knowledge, there hasn’t been a NEW recall as of yet. Though I might have missed it. The most recently recalled hip implant was the DePuy ASR XL implant, and that was in 2010.
The Zimmer Durom Cup was recalled in 2008. And there is something that’s considered typical “Zimmer hip pain.”
The Stryker Trident recall was earlier still. If you’re affected by either of those, you should get legal advice fast. The recalls don’t have to have been in 2011 in oirder for you to be compensated this year. However, if you wait too long, you’re out of luck.
The real significance of Hip Recall 2011
The thing is that people had hip problems long before the above implants were recalled. In fact, they were recalled BECAUSE they were causing so many problems. So if you have a problem now, even if your implant is not on the recall list, you should still get help. You still might need to have it replaced. And you still might be eligible for compensation, recall or no recall.
VERY Important Piece of Advice
When you do have surgery, and have your hip implant replaced, insist that they preserve your hip implant and GIVE it to you.
Tell your surgeon NOT To send it back to the manufacturer. This hip implant can be crucial evidence in a potential compensation lawsuit and could make the difference between you getting fair compensation and getting nothing.
So don’t let anyone bully you into giving in if they say they don’t “usually” do that. Talk to your lawyer. Have them generate whatever paperwork they create to help things along. And get that implant!
What can you get compensated for?
If you believe you won’t get much money and it might not be worth it, think again.
If you’ve been injured by a faulty or defective medical device, you could get compensation (provided you’re represented by a good lawyer).
And here are just some of the things you can get compensation for:
Medical bills, pain and suffering, rehabilitation, future medical care, loss of wages, loss of quality of life, and much more. And that doesn’t even go to the punitive damages that can be many times the amount of those “normal” damages.
